On August 23, 2013, we received the following allegations against Red Leaf Lending: “Company had someone call me stating they would be at my home or my job to issue me a summons to appear in court because the ACH transaction could not go through and in their contract, that is considered a bounced check, which in return they can sue me for. The loan was for $500 and now they say I owe over $1000 even though the website says I owe $650 (loan + fees). To avoid going to court I had to contact the mediation department before Friday. Mediation department told me I had to pay what was due to avoid going to court. I found out payday loans are illegal in NJ and, after checking the state’s regulatory website, they are not licensed. I am still trying to determine if the same laws apply for online loans but am looking at a few articles. I think it’s still illegal.”
On Sept. 10, 2013, we received these allegations against Red Leaf Lending: “Took a $400.00 loan out with Red Leaf Lending and they took 4 payments of $120.00 and a fifth payment of $140.00. Paid back $620.00, $220 over what I owed during 5 biweekly pay periods. I found out that payday loans are illegal in New York State and I sent an email to them indicating that I was revoking my ACH and did so with my bank at the end of May. They sent me text messages saying that my payment was late and I again told them that Payday loans are illegal in New York State, void and unenforceable. Started getting calls from a company called EFinance. In July, Redleaf created an eCheck and took $442.00 out of my account. I vehemently disputed this with my bank and 2 weeks later my money was refunded and put back into my account. Started getting calls and a letter from Total Recovery Solutions, now telling me I owe $700+ to them due to my loan with Redleaf. Finally contacted an attorney, sent out a wage revocation letter and Cease & Desist letter. Closed my bank account and filed a formal complaint with the New York State Department of Financial Services. Haven’t heard back from them yet but I want all of my money refunded. These people are very organized at ripping people off and they do not care about state laws until you make a formal complaint. If you live in a state where payday loans are illegal, then you do not have to pay them back and they cannot arrest you. They should be shut down for their practices as they are bottom feeders of the worst kind!”
